Terms and Conditions

Establishment of the Agreement: by placing your order you indicate your agreement with the Terms and Conditions.
The agreement comes into effect when Rimskys-Horns B.V. confirms your order by e-mail.

Rimskys-Horns B.V. is entitled to dissolve an agreement or to attach special conditions to the delivery, while giving reasons. You are obliged to take delivery of and pay for all products ordered.

1. Prices, price changes and (delivery) costs Currency, VAT:

All prices for new products in Rimskys-Horns B.V.'s shop are in euros and include 21% VAT.
Price changes Rimskys-Horns B.V. is entitled to adjust prices in the interim. In the event of price changes, the agreed prices will be applied to all orders already placed. By agreed prices is meant the price applicable at the time the order is placed.

Shipping costs: The prices mentioned in the shop of Rimskys-Horns B.V. do not include shipping costs. The amount of shipping costs depends on the article you order.

2. Payment-You can pay in several ways:

Via Paypal at account number: ericborninkhof@gmail.com
By means of a bank transfer to ABNAMRO bank account number NL36ABNA0588560022 in the name of Rimskys-Horns quoting the invoice number. A bank transfer must be made within 7 days of receipt or through the webshop in many other ways or otherwise agreed as a prepayment.

3. Order, stock and cancellation Order: 

If you choose to pay by means of a bank transfer, the payment must be received by Rimskys-Horns B.V. within 14 working days at the latest. If your payment has not been received by Rimskys-Horns B.V. within these 14 working days, Rimskys-Horns B.V. will send you a reminder in which you are given the opportunity to again credit your payment to the account of Rimskys-Horns B.V. within 5 working days.

Stock: Delivery of articles takes place while supplies last. Rimskys-Horns B.V. makes every effort to inform you about the availability of each article. This basically means that as soon as an article is out of stock, you will be informed as soon as possible.

Cancellation: It is not possible to cancel placed orders. You will have to reimburse expenses already incurred by Rimskys-Horns B.V.

4. Delivery and transportation Delivery term:

Delivery:-Rimskys-Horns B.V. will attempt to ship the order within 24 hours of receiving payment. Exceeding this delivery period shall not entitle you to compensation nor to cancel your order, unless the exceeding of the delivery period is such that you cannot reasonably be required to maintain the agreement.

Transport: Rimskys-Horns B.V. is not liable for loss or damage occurring during transport. For loss or damage during transport, Rimskys-Horns.com refers to the general terms and conditions of the carrier. Rimskys-Horns B.V. hereby undertakes to pack goods properly in order to minimize the risk of damage. Customer shall always pay the shipping costs incurred by Rimskys-Horns on behalf of sending for testing of instruments by Customer, unless otherwise agreed with Rimskys-Horns.

5. Returns and Exchanges.

ReturningYou are entitled to return items (within the EU) within 3 weeks of receipt, undamaged and in their original packaging, properly packed and with sufficient postage, to Rimskys-Horns B.V. Sint Theresiastraat 30, 3762CZ in Soest, The Netherlands. If you meet the specified conditions, Rimskys-Horns.com will refund the purchase price to your bank account within 5 working days after receipt of the product.

Exchange: Rimskys-Horns B.V. does not have a separate procedure for exchanging an article. If you wish to exchange something, you must return the article to be exchanged as described above and send the desired article to us. Upon receipt of the returned item, Rimskys-Horns B.V. will send you the other article desired by the customer.

6. Warranty and Liability: 

Warranty: Your order will be carried out with the utmost care. Should the products have or get defects, the following provisions apply: - If the product upon receipt already has a flaw, defect or serious damage not resulting from transportation, you have the right to return the article within 3 weeks after receipt. The defective or damaged item must be returned to us in its original packaging, properly packed and with sufficient postage. If you meet the set conditions, Rimskys-Horns B.V. will, after receipt of the article and after assessment and determination of the defect or damage, send you a new or replacement copy of the article or, if the article is no longer in stock, refund the purchase price plus the paid shipping costs to your bank account within 5 working days. If the product starts to show defects or faults in use only after receipt, Rimskys-Horns B.V. uses the following warranty periods: > Horns 12 months > Gig Bags 3 months > other products will be delivered without warranty but with compensation arrangements. Colors may always differ from the pictures shown and the actual colors. Each different brand of computer screen displays colors differently.

Liability: Rimskys-Horns B.V. accepts no liability to you for any damage other than in the event that its liability insurance covers the damage and to the extent that the insurer pays out in such case. Outside the aforementioned cases, liability is always limited to a maximum of the purchase price of the article(s) in question. Rimskys-Horns B.V. shall never be liable for consequential damages. However, Rimskys-Horns B.V. will always try to help reach a customer-friendly solution to the problem. Rimskys-Horns B.V.may at any time terminate an auction and convert it to a regular sale if the possessor of the instrument indicates that he wishes to obtain a higher amount for his possession.

7. Communication and copyright Communication:

Rimskys-Horns B.V. is not liable for any misunderstandings, mutilation, delays or improper transmission of order details and messages resulting from the use of the Internet or any other means of communication in the traffic between you and Rimskys-Horns B.V. or between Rimskys-Horns B.V. and third parties, insofar as these concern the relationship between you and Rimskys-Horns B.V., unless and insofar as there has been an intentional act or omission or gross negligence by Rimskys-Horns B.V.

Copyright: Nothing from the Rimskys-Horns B.V. webshop may be used or copied by third parties without Rimskys-Horns B.V.'s prior written permission.

8. Privacy:

By ordering, you simultaneously give Rimskys-Horns B.V. permission to use your personal data. Your data will be used for evaluating, entering into and executing the delivery agreement and maintaining the customer relationship with you. Your data will only be included in our customer file and will not be provided to third parties.

9. Amendment of general terms and conditions:

Rimskys-Horns B.V. is entitled to amend its General Terms and Conditions at any time. Each agreement is subject to the version of the General Terms and Conditions in force at the time of the conclusion of the agreement. All rights reserved to: Rimskys-Horns B.V. 10. Applicable law and competent court:

All rights, obligations, offers, orders and agreements to which these Conditions apply, as well as these Conditions, are exclusively governed by Dutch law. All disputes between the parties shall be submitted exclusively to the competent court in the Netherlands.
